TERMS OF SERVICE

Community guidelines, rules, and policies governing membership and operations at Air Transat Virtual.

Acceptance of Terms

By registering an account with Air Transat Virtual, accessing our Crew Centre platform, downloading our resources, participating in community events, or engaging in any Air Transat Virtual activities (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable international, federal, provincial, and local laws and regulations.

If you disagree with any part of these Terms, you are prohibited from accessing or using Air Transat Virtual's Services. Your continued use of our Services following the posting of any changes to these Terms constitutes acceptance of those changes.

Air Transat Virtual is a non-commercial, non-profit flight simulation community operated entirely by volunteers for educational and recreational purposes. We are not affiliated with, endorsed by, or connected to Air Transat, Transat A.T. Inc., or any real-world airline, aircraft manufacturer, or aviation authority.

The use of Air Transat trademarks, logos, liveries, route networks, and operational procedures is for flight simulation purposes only under the principles of fair use, fair dealing (Canadian Copyright Act Section 29), and non-commercial educational use. No endorsement or real-world association is implied or intended.

These Terms may be updated at any time without prior notice, though we will make reasonable efforts to notify active members of material changes via email or Discord announcements at least 30 days before the effective date. We encourage you to review this page periodically. The "Last Updated" date at the top indicates when the most recent modifications were made.

Important: By clicking "I Agree" during registration, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Membership Requirements & Eligibility

Eligibility Criteria

To register and maintain membership with Air Transat Virtual, you must meet the following eligibility requirements:

  • Minimum Age: You must be at least 13 years of age. Pilots under 18 may require parental consent depending on jurisdiction.
  • Accurate Information: You must provide truthful, accurate, and complete information during registration and keep your profile updated.
  • Single Account Policy: You may maintain only one (1) active account with Air Transat Virtual at any time. Multiple or duplicate accounts are strictly prohibited.
  • Network Membership: You must hold an active membership with VATSIM or IVAO and provide your network ID for verification purposes as required by network VA recognition policies.
  • Flight Simulation Software: You must have access to approved flight simulation platforms (Microsoft Flight Simulator, X-Plane, Prepar3D, or equivalent) capable of running our ACARS client.
  • Discord Account: You must maintain an active Discord account for community access, official communications, training coordination, and event participation.
  • Good Standing: You must not be banned or suspended from other virtual airlines for violations of their terms of service, code of conduct, or fraudulent activity (subject to management discretion).

Activity Requirements

To maintain active pilot status within Air Transat Virtual and avoid account suspension, members must adhere to the following activity standards:

  • Minimum Flight Requirement: Complete at least one (1) PIREP-submitted flight every 30 days
  • Community Participation: Maintain an active presence in our Discord community (occasional check-ins, event participation encouraged but not mandatory)
  • Inactivity Warnings: Pilots will receive automated email reminders at 25, 28, and 30 days of inactivity
  • Automatic Suspension: Accounts showing no activity for 45 consecutive days without an approved Leave of Absence (LOA) will be automatically suspended
  • Reactivation: Suspended accounts may be reactivated upon request within 90 days of suspension, subject to management approval and eligibility review
  • Permanent Deletion: Accounts inactive for more than 120 days total (45 days active + 90 days suspended) will be permanently deleted and all data anonymized per our Privacy Policy

Leave of Absence (LOA) Policy

We understand that real-life commitments may temporarily prevent flight activity. Members may request a Leave of Absence under the following conditions:

  • Maximum Duration: LOA may be granted for up to 90 days, with extensions available upon request
  • Request Process: Submit LOA requests via Crew Centre ticket system or Discord with reason and expected return date
  • Account Protection: Activity requirements are waived during approved LOA period; your rank, hours, and statistics are preserved
  • Return Notification: Notify management when returning from LOA to resume active status

Code of Conduct & Community Standards

All Air Transat Virtual members are expected to maintain the highest standards of professionalism, respect, and integrity at all times. Our community thrives on mutual respect, collaboration, and shared passion for aviation. The following behaviors are strictly prohibited and may result in immediate suspension or permanent termination:

Harassment & Discrimination

Any form of harassment, bullying, discrimination, hate speech, or intimidation based on race, ethnicity, national origin, gender, sexual orientation, religion, disability, age, or any other protected characteristic. This includes offensive jokes, slurs, personal attacks, doxxing, or unwelcome sexual advances.

Cheating & Fraudulent Activity

Falsifying flight data, PIREP manipulation, using unauthorized tools or exploits, submitting fraudulent PIREPs, gaming statistics, creating duplicate accounts, or any attempt to circumvent our systems for unfair advantage or ranking manipulation.

Network Code Violations

Violating VATSIM Code of Conduct (CoC), VATSIM Code of Regulations (CoR), IVAO User Agreements, or any network-specific rules while flying under Air Transat Virtual callsign. This includes controller harassment, frequency trolling, unrealistic operations, or any behavior resulting in network suspension.

Disruptive & Toxic Behavior

Trolling, spamming, excessive profanity, inflammatory comments, doxxing, sharing explicit content, spreading misinformation, impersonating staff or other members, or any behavior that disrupts community harmony, event operations, or creates a hostile environment.

Intellectual Property Theft

Unauthorized use, redistribution, or commercial exploitation of Air Transat Virtual's proprietary materials including liveries, documentation, training materials, logos, or website content without explicit written permission from management.

Illegal Activities

Sharing pirated software, distributing illegal content, hacking or attempting unauthorized access to our systems, phishing, scamming, or engaging in any activity that violates Canadian federal law, provincial regulations, or international law.

Expected Professional Behavior

  • Respect & Courtesy: Treat all members, staff, and network controllers with respect, professionalism, and courtesy at all times
  • Positive Representation: Represent Air Transat Virtual positively on VATSIM, IVAO, Discord, social media, and all public platforms
  • Policy Compliance: Follow all Air Transat Virtual procedures, Standard Operating Procedures (SOPs), training requirements, and management directives
  • Incident Reporting: Promptly report any violations, technical issues, safety concerns, or inappropriate behavior to management via Discord tickets or email
  • Constructive Communication: Provide constructive feedback, assist new pilots, and contribute positively to community discussions and improvement initiatives
  • Safety Culture: Promote a culture of safety, realism, and continuous learning; share knowledge and experiences to help others improve

Enforcement & Disciplinary Actions

Violations of this Code of Conduct will be reviewed by management on a case-by-case basis. Disciplinary actions may include, but are not limited to:

  • Verbal/Written Warning: Official documentation of violation with corrective action plan
  • Temporary Suspension: 7-30 day account suspension with loss of privileges
  • Rank Demotion: Reduction in rank with re-training requirements
  • PIREP Rejection: Rejection of fraudulent or non-compliant flight reports
  • Permanent Termination: Immediate and permanent account deletion for severe violations

Appeals: Members may appeal disciplinary actions by submitting a formal request to management within 14 days of action. All decisions are final and at management's sole discretion.

Flight Operations & PIREP Requirements

Mandatory Flight Rules

All flights operated under Air Transat Virtual must adhere to the following operational standards to maintain realism, safety, and community integrity:

  • Callsign Usage: All flights must use official Air Transat callsigns (TSC/TRANSAT) as assigned in the Crew Centre scheduling system
  • Approved Liveries: Flights must use current or historical Air Transat Virtual approved liveries when available for your aircraft type
  • Fleet Restrictions: Only aircraft listed in the official Air Transat Virtual fleet database may be flown, unless special approval is granted by management for events or training
  • Route Compliance: Flights must originate from published schedules, timetable routes, or approved charter/special operations. Random routing requires prior approval
  • ACARS Requirement: All flights must be tracked using our approved ACARS client (SmartCARS 3 or VMS ACARS) from engine start to shutdown
  • PIREP Submission: Pilot Reports (PIREPs) must be submitted within 48 hours of flight completion via ACARS or manual filing (with valid reason)
  • Realistic Operations: Flights must follow realistic procedures including proper taxi speeds, climb/descent rates, cruising altitudes, and approach patterns
  • Network Compliance: When flying on VATSIM or IVAO, comply with all ATC instructions, network regulations, and real-world aviation procedures

Time Acceleration & Simulation Rate

To maintain realism and prevent unfair ranking advantages, the following time acceleration policies apply:

  • Cruise Phase: Maximum 4x time acceleration is permitted during cruise flight above FL250
  • Critical Phases: 1x real-time only during taxi, takeoff, climb below FL250, descent below FL250, approach, and landing
  • Network Flights: Time acceleration is prohibited when connected to VATSIM or IVAO
  • Monitoring: ACARS tracks simulation rate; excessive or inappropriate acceleration will result in PIREP rejection

PIREP Rejection & Audit Criteria

PIREPs may be rejected, flagged for audit, or result in disciplinary action for the following violations:

  • Excessive Time Acceleration: Use of time acceleration beyond allowed limits or during prohibited flight phases
  • Unrealistic Parameters: Excessive speed violations (overspeed by >20 knots sustained), altitude deviations (>1000ft from assigned), unrealistic climb/descent rates
  • Missing ACARS Data: Incomplete flight tracking, GPS coordinate gaps, missing fuel/weight data, or evidence of ACARS manipulation
  • Extreme Landing Rates: Landing rates exceeding -1000 fpm (crashes) or suspiciously perfect landings (-10 fpm consistently)
  • Aircraft Restrictions: Flying aircraft not assigned to your rank, type ratings, or qualifications without authorization
  • Route Violations: Flying unapproved routes, wrong airports, or significant route deviations without valid reason
  • Duplicate Submissions: Submitting the same flight multiple times or overlapping flight times
  • Evidence of Cheating: Statistical anomalies, impossibly consistent performance, or use of third-party tools to manipulate data

Type Ratings & Aircraft Qualifications

Air Transat Virtual operates a realistic type rating system. Pilots must complete appropriate training before flying specific aircraft types:

  • Narrow-Body Jets (A321neo, A321LR): Available to all pilots from Second Officer rank
  • Wide-Body Jets (A330-200, A330-300): Requires First Officer rank + A330 type rating course completion
  • Type Rating Courses: Available through Air Transat Virtual Academy with written exam and check flight requirements
  • Currency Requirements: Pilots must fly each aircraft type at least once every 90 days to maintain currency

Best Practices for Quality PIREPs

  • Use real-world weather (active sky, METAR injection) for added realism
  • Follow proper checklists and SOP procedures throughout the flight
  • Add detailed remarks about weather, ATC interactions, or notable events
  • Submit PIREPs promptly to avoid forgetting flight details
  • Screenshot key moments (departure, cruise, arrival) for your logbook memories

Intellectual Property & Content Rights

Trademark & Brand Usage

Air Transat® and Transat A.T. Inc.® are registered trademarks of Transat A.T. Inc., a Canadian airline company. Air Transat Virtual is an independent, non-commercial flight simulation community with no official affiliation, endorsement, partnership, or connection to Air Transat, Transat A.T. Inc., or any subsidiary entities.

The use of Air Transat trademarks, logos, livery designs, route networks, flight numbers, operational procedures, and branding elements is for non-commercial flight simulation and educational purposes only under the following legal frameworks:

  • Canadian Copyright Act Section 29: Fair dealing provisions for research, private study, education, and criticism
  • Trademarks Act (Canada): Non-commercial use without intent to cause confusion or misrepresentation
  • Fair Use Doctrine (International): Transformative non-commercial use for hobbyist and educational purposes

Air Transat Virtual operates as a tribute community celebrating Air Transat's operational excellence and Canadian aviation heritage. We make no claim to ownership of any Air Transat intellectual property and explicitly disclaim any official association or endorsement.

Air Transat Virtual Original Content

All original content created by Air Transat Virtual staff, including but not limited to the following, remains the intellectual property of Air Transat Virtual:

  • Website Design & Code: HTML, CSS, JavaScript, PHP, database schemas, UI/UX design elements
  • Documentation: Training manuals, SOPs, pilot guides, academy courses, route documentation
  • Graphics & Assets: Custom banners, badges, rank insignia, promotional materials, infographics
  • Software & Tools: Custom ACARS configurations, plugins, utilities, automation scripts
  • Livery Adaptations: Modified textures, repaints, and custom livery configurations for simulation use

Prohibited Uses

Members and visitors are strictly prohibited from the following activities without explicit written permission:

  • Commercial Use: Selling, licensing, or commercially exploiting any Air Transat Virtual content, materials, or intellectual property
  • Unauthorized Redistribution: Sharing, republishing, or distributing proprietary materials on other websites, forums, or platforms
  • Modification & Derivative Works: Creating modified versions, derivative works, or adaptations of our content without permission
  • Reverse Engineering: Decompiling, disassembling, or reverse-engineering any Air Transat Virtual software or systems
  • Impersonation: Representing yourself as Air Transat Virtual staff or using our branding to create confusion or misrepresentation

User-Generated Content License

By submitting content to Air Transat Virtual (screenshots, flight reports, forum posts, Discord messages, reviews), you grant Air Transat Virtual a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content for promotional, operational, and community purposes. You retain ownership of your original content. You represent and warrant that you have the right to grant this license and that your content does not violate any third-party rights or laws.

DMCA & Copyright Infringement

Air Transat Virtual respects intellectual property rights. If you believe any content on our platform infringes your copyright, please contact us at legal@transatvirtual.com with:

  • Description of the copyrighted work
  • Location (URL) of infringing material
  • Your contact information
  • Statement of good faith belief

We will investigate all claims promptly and take appropriate action, including content removal if warranted.

Account Termination & Suspension

Voluntary Account Closure

Members may voluntarily close their account at any time by submitting a request through:

  • Email: Send account deletion request to support@transatvirtual.com
  • Discord: Open a support ticket in our Discord server requesting account closure
  • Crew Centre: Use the "Delete Account" option in your profile settings (requires confirmation)

Upon account closure: Your personal data will be deleted within 30 days per our Privacy Policy; flight data will be anonymized and retained for statistical purposes; access to Crew Centre, Discord, and all resources will be immediately revoked; account closure is irreversible—all ranks, hours, and achievements will be permanently lost.

Involuntary Termination by Management

Air Transat Virtual reserves the right to suspend or terminate any account immediately and without prior notice for:

  • Terms Violations: Breach of these Terms of Service, Privacy Policy, or Code of Conduct
  • Fraudulent Activity: PIREP manipulation, statistics falsification, duplicate accounts, or cheating
  • Harassment & Abuse: Bullying, discrimination, threats, or creating a hostile environment
  • Network Violations: VATSIM/IVAO suspension or ban while representing Air Transat Virtual
  • Illegal Activities: Sharing pirated software, hacking attempts, or engaging in unlawful conduct
  • Repeated Violations: Pattern of rule-breaking, warnings ignored, or failure to comply with corrective actions

Appeals Process

Members who believe their termination or suspension was issued in error may submit a formal appeal:

  • Timeline: Appeals must be submitted within 14 calendar days of termination/suspension notice
  • Format: Written appeal sent to appeals@transatvirtual.com with detailed explanation and supporting evidence
  • Review: Appeals are reviewed by senior management (not the original decision-maker) within 30 days
  • Decision: Management's appeal decision is final and binding with no further recourse

Consequences of Termination

  • Immediate loss of Crew Centre access and all account privileges
  • Removal from Air Transat Virtual Discord server and community platforms
  • Permanent loss of all flight hours, ranks, awards, and statistics
  • Personal data deletion within 30 days per GDPR/PIPEDA requirements
  • Prohibition from re-registering without explicit management approval
  • No refunds or compensation (as this is a free, non-commercial service)

Limitation of Liability & Disclaimers

"As-Is" Service Disclaimer

Air Transat Virtual provides all services, website, Crew Centre, ACARS systems, documentation, and resources on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties regarding accuracy, reliability, or completeness of content
  • Warranties of uninterrupted, secure, or error-free service
  • Warranties that defects will be corrected or that servers are virus-free

Air Transat Virtual is a volunteer-operated, non-commercial community. We make no guarantees regarding service availability, data persistence, or operational continuity. The service may be modified, suspended, or discontinued at any time without notice.

Limitation of Liability

To the maximum extent permitted by applicable law, Air Transat Virtual, its administrators, staff members, volunteers, partners, and affiliates shall NOT BE LIABLE for any:

  • Indirect, incidental, consequential, special, or punitive damages arising from your use or inability to use our services
  • Data loss, corruption, or deletion including loss of flight hours, PIREPs, statistics, or account information
  • Service interruptions, errors, bugs, or technical failures affecting website, ACARS, or Crew Centre functionality
  • Security breaches, unauthorized access, or data privacy incidents despite our reasonable security measures
  • Actions of other users including harassment, misinformation, or community disputes
  • Third-party content or links including external websites, tools, or resources we may reference
  • Damage to flight simulation software, hardware, or computer systems from ACARS or downloaded materials

In no event shall Air Transat Virtual's total liability exceed $0 CAD, as this is a free, non-commercial service with no financial transactions or monetary exchange.

Indemnification

You agree to indemnify, defend, and hold harmless Air Transat Virtual, its staff, volunteers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your violation of any third-party rights, including intellectual property or privacy rights; (c) your use or misuse of Air Transat Virtual services; (d) your conduct on VATSIM, IVAO, or other networks while representing Air Transat Virtual; or (e) any content you submit or actions you take within our community.

Third-Party Links & Content

Air Transat Virtual may contain links to third-party websites, resources, or services (e.g., VATSIM, IVAO, flight planning tools, SimBrief, aircraft developers). These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites. Your use of third-party services is at your own risk and subject to their respective terms and policies.

Important Notice

Air Transat Virtual is a hobby community operated entirely by volunteers in their spare time. We provide this service free of charge for the enjoyment of flight simulation enthusiasts. While we strive for quality and reliability, we cannot guarantee perfection or immediate support. By using our services, you acknowledge and accept these limitations. Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

Governing Law & Miscellaneous Provisions

Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Quebec and Canada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Air Transat Virtual services shall be subject to the exclusive jurisdiction of the courts located in Montreal, Quebec, Canada. You consent to personal jurisdiction and venue in these courts. For international users, local consumer protection laws may also apply.

Dispute Resolution

Before initiating any formal legal action, parties agree to attempt resolution through the following process:

  • 1. Informal Negotiation: Contact Air Transat Virtual management to discuss the issue
  • 2. Mediation: If unresolved after 30 days, parties agree to good-faith mediation
  • 3. Arbitration/Litigation: Only after exhausting the above may formal legal action be pursued

Severability & Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. Air Transat Virtual's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Air Transat Virtual.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies explicitly referenced herein, constitute the entire agreement between you and Air Transat Virtual regarding the use of our services. These Terms supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral, regarding the subject matter herein.

Assignment & Transfer

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without Air Transat Virtual's prior written consent. Any attempted assignment in violation of this provision shall be null and void. Air Transat Virtual may freely assign or transfer these Terms and all associated rights and obligations to any third party without restriction or notification.

Language

These Terms of Service are provided in English. Any translations provided for convenience purposes are not legally binding. In the event of any discrepancy between the English version and a translated version, the English version shall prevail.
